Law Enforcement Safety Act HR 218

The Law Enforcement Officers Safety Act (also known as HR 218) permits the nationwide carrying of concealed handguns by qualified current and retired law enforcement officers.  It is the policy of the RPD to comply with HR 218 for those members who meet the qualifications established by this law. You can Download the instruction sheet.

Qualified retired members will be required to sign a waiver of liability from the Rochester Police Department (RPD) for all acts taken in relation to carrying a concealed firearm.   

Range times for retiree qualifications will be determined by the RPD Firearms Training Unit.  

Eligible retired members will be permitted to qualify on one or more concealable firearm as time and scheduling permits. 

Eligible retired members must qualify annually and must:

  • Provide the RPD with a signed waiver containing pertinent information 30 days prior to the qualification date for the purpose of a National Instant Criminal History Check and approval for participation. Members who are determined to be ineligible will be notified prior to the qualification date.
  • Deliver the notarized waiver to the HQ Desk between 11:00 a.m. and 2:00 p. m., where you can also have your photograph taken.
  • Bring handgun(s) capable of being loaded with 5 or more rounds.  Those shooting handguns with barrels longer than 3” will need to carry spare ammunition on your belt for a reload stage of fire.
  • Bring 75 rounds of factory-issued ammunition for the weapon.  (50 rounds of ammunition is required for each qualification) 
  • Provide your own cleaning supplies.
  • Have a secure holster that completely covers the trigger.  It will be worn on the ‘strong side’ hip only either in the waist band or on the pants belt.  The opening of the holster must not close after the handgun is unholstered.
  • All handguns and holsters must be in good repair and pass a safety inspection by the Firearms Training Unit.
  • Provide the Firearms Training Unit with your photographic retiree Department-issued identification card and a valid New York State Pistol Permit listing the weapon used for qualification.
